Terms of service

These terms (the "Terms") govern your access to and use of Human Hygiene Kft. (the "Shop") and the purchase of goods or services through it. By placing an order or otherwise using the Shop, you agree to be bound by these Terms. If you do not agree, do not use the Shop.

2. Definitions

"Consumer" means a natural person acting outside of any trade, business, craft or profession. "Business customer" means any other buyer. "Goods" means tangible items offered for sale in the Shop; "Digital content" means files, downloads or online services offered for sale in the Shop. "Order" means your offer to buy presented through the Shop's checkout flow. "Contract" means the binding agreement formed when we accept your Order in writing.

3. Eligibility

By using the Shop you confirm that you are at least 18 years of age, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into binding contracts. We reserve the right to refuse service to any person, at our sole discretion, where local law permits.

4. Orders and conclusion of contract

The display of goods in the Shop is an invitation to treat, not a binding offer. By submitting an Order at checkout, you make us a binding offer to buy the items selected. We will acknowledge receipt of your Order by email; acknowledgement does not in itself constitute acceptance. A Contract is formed only when we either (a) confirm acceptance of your Order in a separate email, or (b) dispatch the goods, whichever happens first.

We may refuse to accept an Order — for example if a product is no longer in stock, if a price has been mis-stated, if we are unable to verify your payment, or if we suspect the Order is fraudulent or in breach of these Terms. If we refuse an Order after payment has been taken, we will refund the amount paid promptly.

5. Prices, taxes and payment

Prices are shown in the Shop in the displayed currency and include VAT at the applicable rate, where due. Delivery costs and any other charges are shown separately at checkout before you commit to the Order.

We accept the payment methods presented at checkout. Payment is due at the time the Order is placed. Title (legal ownership) in the goods passes to you on full payment; risk in the goods passes to you on delivery.

6. Delivery (physical goods)

We deliver to the address you provide at checkout, using the carriers presented at checkout. Delivery times displayed in the Shop and in our communications are good-faith estimates and are not contractually guaranteed unless we expressly state otherwise. If we are unable to deliver within 30 days from the day after the Contract is formed (or within any longer period agreed with you), you may cancel the Contract for a full refund.

7. Digital content

Where we offer digital content (files, downloads or online services), it is made available for download or access immediately after payment is confirmed. By placing the Order for digital content, you (a) expressly request that performance begins immediately and (b) acknowledge that you thereby lose the statutory right of withdrawal once performance has begun, in line with Article 16(m) of EU Directive 2011/83/EU.

8. Right of withdrawal (consumers only)

If you are a consumer based in the EU, you have the right to withdraw from the Contract within 30 days of taking physical possession of the goods, without giving any reason. To exercise this right, you must inform us of your decision to withdraw by an unambiguous statement (for example a letter sent by post or an email to info@human-hygiene.hu). You may use the model withdrawal form set out in our Refunds & returns page, but you are not obliged to. The deadline is met if you send the communication before the 30-day period has expired.

Statutory exceptions to the right of withdrawal apply — see the Refunds & returns page for the full procedure, the consequences of withdrawal, the model form, and the categories of goods to which the right does not apply (e.g. perishable goods, hygienically-sealed items unsealed after delivery, custom-made or personalised goods).

9. Conformity of goods

We are responsible to consumers for any lack of conformity of the goods at delivery for the period required by the consumer-protection law of your habitual residence (in most EU member states this is at least 2 years from delivery, with the option in some states for a shorter period for second-hand goods). Where goods do not conform, you may require repair or replacement at no cost to you, or — under the conditions set out in your local law — a proportionate price reduction or termination of the Contract. Bring any defect to our attention without undue delay; this helps us help you, but the statutory remedies remain available regardless.

10. Intellectual property

All trademarks, product designs, photographs, copy, the Shop's design and software, and other intellectual property displayed in the Shop are owned by us or our licensors and are protected by applicable IP laws. Nothing in these Terms grants you any licence to use any of these other than the strictly personal, non-commercial use necessary to view the Shop and process your Order.

11. Liability

We do not exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) defective products under the EU Product Liability Directive (85/374/EEC) as transposed into your national law; or (d) any other liability that cannot be excluded under applicable mandatory law. For all other claims arising under or in connection with the Contract, our aggregate liability is limited to the price you paid for the goods that gave rise to the claim. We are not liable for indirect, incidental, consequential or purely economic losses (including loss of profit, loss of business, or loss of opportunity), and we are not liable for any failure or delay caused by an event outside our reasonable control (force majeure).

12. Online dispute resolution

The European Commission provides an online dispute resolution (ODR) platform that consumers can use to resolve disputes out of court: https://ec.europa.eu/consumers/odr. Our email address for the purposes of this platform is info@human-hygiene.hu. We are not obliged, nor do we currently undertake, to participate in dispute resolution procedures before a consumer arbitration body, but we are committed to dealing with any complaint promptly and fairly through direct contact.

13. Privacy

We process personal data in connection with your Order and your use of the Shop. Our Privacy policy explains what data we collect, why, how long we keep it, who we share it with, and the rights you have under the EU General Data Protection Regulation (Regulation (EU) 2016/679 — GDPR). Please read it carefully.

14. Cookies

The Shop uses cookies and similar technologies that are strictly necessary for the Shop to function (e.g. cart, session), and — only with your consent — analytics and marketing cookies. See the cookie banner displayed on first visit, and our Privacy policy for full detail.

15. Changes to these Terms

We may amend these Terms from time to time to reflect changes in the law, our business, or our offering. The version in force at the time you place an Order is the version that governs that Contract. We will publish updated Terms on this page and update the "Last updated" date below.

16. Severability and entire agreement

If any provision of these Terms is found by a competent court to be unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy policy and the Refunds & returns page, constitute the entire agreement between you and us in relation to the Shop and your Order, and supersede any prior agreements or representations.

17. Governing law and jurisdiction

These Terms and any Contract are governed by the law of Hungary (the country in which Humán Hygiene Kft is established), without prejudice to any mandatory consumer-protection rules of the country in which you have your habitual residence. Where you are a consumer, you may bring proceedings in the courts of your country of residence; in all other cases the courts of Hungary have non-exclusive jurisdiction.
